Matter | Examination and Approval (Modification) of the Practicing Registration of Provincial Medical Institutions |

II. Basis | i. Article 20 of the Regulation on the Administration of Medical Institutions (Order No. 149 of the State Council issued on February 26, 1994, revised according to the Provisions of the State Council on the Amendment of Some Administration Regulations on February 6, 2016): A medical institution changing its name, site, the primary person in charge, diagnosis and treatment items, and sickbeds shall undergo the formalities of modification registration with the original registration authority; ii. Implementation Rules for the Regulation on the Administration of Medical Institutions (Order No. 35 of the Ministry of Health issued on August 29, 1994, effective on September 1, 1994, revised according to the notice of the Ministry of Health on Article 3 of the Implementation Rules for the Regulation on the Administration of Medical Institutions on November 1, 2016 and effective on April 1, 2017 according to the decision of the National Health and Family Planning Commission on the amendment of the Implementation Rules for the Regulation on the Administration of Medical Institutions on February 21, 2017) Article 29 A medical institution reserved due to division or merger shall apply for modification registration; a medical institution newly established due to division or merger shall apply for permission for establishment and practicing registration; and a medical institution terminated due to merger shall apply for deregistration. Article 30 To change the name, address, legal representative or primary person in charge, ownership form, service recipient, service mode, registered capital, diagnosis and treatment items, or sickbeds (dental chairs), a medical institution must apply to the registration authority for handling modification registration and submit the following materials: 1. The Modification Registration Application of a Medical Institution signed by the legal representative or the primary person in charge of the medical institution; 2. The reasons and causes for applying for modification registration; and 3. Other materials required by the registration authority. Article 31 Medical institutions established by organs, enterprises and public institutions for serving internal employees that are to be available to the public shall apply to undergo the formalities of modification registration under the provisions of the preceding article. Article 32 A medical institution that changes the registered items within the scope of the jurisdiction of the original registration authority shall undergo the formalities of modification registration with the original registration authority; and where the scope of the jurisdiction of the original registration authority is exceeded due to modification registration, the institution shall undergo the formalities of modification registration with the health administrative department with the jurisdiction. iii. The Decision of the People's Government of Hainan Province on Retaining, Adjusting and Canceling Administrative Licensing Items (Order No. 179 of the Hainan Provincial Government); implementing entity: Hainan Provincial Department of Health; licensing item: Practicing registration of medical institutions. |
III. Acceptance Conditions | Any changes to the name, address, legal representative or primary person in charge, ownership form, service recipient, service mode, registered capital, diagnosis and treatment items, or sickbeds (dental chairs) for a medical institution must be submitted to the registration authority for handling modification registration. |
IV. Application Materials | i. The Modification Registration Application of a Medical Institution; ii. The authentic and duplicate copies of the Practicing License for a Medical Institution; iii. The reasons and causes for applying for modification registration; iv. For changes to the name of the institution or the legal representative, relevant departmental documents (including the business license for corporate institutions, public institution legal person certificate for public institutions and registration certificate for private non-enterprise institutions), letter of appointment (both the original and photocopy) and letter of commitment must be submitted; v. For changes involving the addition of diagnosis and treatment items, the following materials shall be provided and submitted: 1. The list of personnel for diagnosis and treatment items to be added (including their names, genders, ages, identification numbers, professional titles and photocopies of physician or nurse qualification certificates); 2. The list of relevant medical equipment corresponding to the diagnosis and treatment items to be added; 3. The plan for the medical premise of the diagnosis and treatment items to be added; 4. The rules and regulations, job responsibilities and technical specifications for medical nursing of the diagnosis and treatment items to be added; and 5. The names of medical technical service projects to be implemented. vi. For changes to the practicing address, the following materials shall be provided: 1. The property certificate or the certificate on the use of the business premise of the medical institution (such as a housing rental certificate or rental contract); 2. The plan for the architectural design of the medical institution; 3. The rules and regulations of the medical institution; and 4. The list of the medical institution's legal representative or primary person in charge and the persons in charge of all departments, and the photocopies of relevant qualification certificates and practicing certificates; vii. For the addition of Internet-based diagnosis and treatment services or the application to designate the Internet hospital as its secondary name at the same time, the following materials shall be provided: 1. The status of the connection to the provincial regulatory platform for Internet-based medical services; 2. The rules and regulations of the medical institution (rules and regulations related to the Internet hospital); 3. The list of relevant medical staff (the list of personnel engaged in Internet-based diagnosis and treatment activities, including their departments, names, professional titles, practicing scope, practicing certificate numbers and identification numbers); and 4. The agreement (if partnering with a third-party institution to establish the Internet hospital and build an Internet-based diagnosis and treatment service information system, this material shall be provided). viii. For delegated applications, a power of attorney and identity certificate of the operator shall be submitted. |

VIII. Handling Procedures | i. Acceptance (if the application materials are complete and consistent with the statutory form, the case shall be accepted in the administration examination and approval system after passing the examination); ii. Review (materials shall undergo professional review and proceed to the re-examination process after passing the preliminary examination); iii. Special processes (the time required for the expert review shall not be included in the promised time limit for handling the matters); and iv. Decision (the decision to approve or not to approve the handling of a case according to the re-examination opinions). |
