II. Basis

i. Article 22 of the Regulation on the Administration of Medical Institutions (Order No. 149 of the State Council issued on February 26, 1994, revised according to the Provisions of the State Council on the Amendment of Some Administration Regulations on February 6, 2016): For a medical institution with less than 100 sickbeds, its Practicing License for a Medical Institution shall be verified once a year; and for a medical institution with more than 100 sickbeds, its Practicing License for a Medical Institution shall be verified once every three years. The verification shall be handled by the original registration authority;

ii. Implementation Rules for the Regulation on the Administration of Medical Institutions (Order No. 35 of the Ministry of Health issued on August 29, 1994, effective on September 1, 1994, revised according to the notice of the Ministry of Health on Article 3 of the Implementation Rules for the Regulation on the Administration of Medical Institutions on November 1, 2016 and effective on April 1, 2017 according to the decision of the National Health and Family Planning Commission on the amendment of the Implementation Rules for the Regulation on the Administration of Medical Institutions on February 21, 2017)

Article 35 The verification period for general hospitals, traditional Chinese medicine hospitals, hospitals of traditional Chinese and Western medicine, hospitals of ethnic minority medicine, specialized hospitals, sanitariums, rehabilitation hospitals, maternal and child health care hospitals, emergency centers, clinic testing centers, and specialist disease prevention and treatment institutions with no less than 100 sickbeds shall be three years; and the verification period for other medical institutions shall be one year.

Medical institutions shall apply to undergo the formalities of verification three months before the expiry of the verification period.

To undergo the formalities of verification, the Practicing License for a Medical Institution shall be submitted for verification and the following documents shall be submitted:

1. Application Form of a Medical Institution for Verification;

2. A duplicate of the Practicing License for a Medical Institution; and

3. Other materials required by the health administrative departments of the provinces, autonomous regions and municipalities directly under the Central Government.

Article 36 The health and family planning department shall complete the verification within 30 days after accepting the application for verification.

iii. The Decision of the People's Government of Hainan Province on Retaining, Adjusting and Canceling Administrative Licensing Items (Order No. 179 of the Hainan Provincial Government); implementing entity: Hainan Provincial Department of Health; licensing item: Practicing registration of medical institutions.

III. Acceptance Conditions

Medical institutions reaching their verification period shall apply for verification. The verification periods are as follows:

i. The verification period for general hospitals, traditional Chinese medicine hospitals, hospitals of traditional Chinese and Western medicine, hospitals of ethnic minority medicine, specialized hospitals, sanitariums, rehabilitation hospitals, maternal and child health care hospitals, emergency centers, clinic testing centers, and specialist disease prevention and treatment institutions with no less than 100 sickbeds shall be three years;

ii. The verification period for other medical institutions shall be one year; and

iii. The verification period for Chinese-foreign joint venture or cooperative medical institutions shall be one year; and

iv. The verification period for medical institutions that have been suspended in verification and subsequently passed the verification shall be one year.  

IV. Application Materials

Medical institutions shall apply for verification three months before the expiry of the verification period and the following materials shall be submitted:

i. Application Form of a Medical Institution for Verification;

ii. The authentic and duplicate copies of the Practicing License for a Medical Institution;

iii. A list of relevant medical staff;

iv. Annual work summaries (which shall include 1. compliance with legal practice requirements; 2. compliance with the basic standards for medical institutions; 3. changes in diagnosis and treatment items, number of sickbeds (dental chairs) and other practice registration items, as well as changes in health technicians, business departments and major medical equipment; 4. results of inspections and guidance from health administrative departments during the verification period, along with any corrective actions taken; 5. medical civil compensation (including medical accidents) and handling of any practicing violations by health technicians during the verification period; and 6. special medical technology projects conducted); and

v. For delegated applications, a power of attorney and identity certificate of the operator shall be submitted.

V. Time Limits for Conclusion

Statutory time limit for the completion of handling: 30 business days

Promised time limit for the completion of handling: 18 business days

VIII. Handling Procedures

i. Acceptance (if the application materials are complete and consistent with the statutory form, the case shall be accepted in the administration examination and approval system after passing the examination);

ii. Review (materials shall undergo professional review and proceed to the re-examination process after passing the preliminary examination);

iii. Special processes (the time required for the expert review shall not be included in the promised time limit for handling the matters); and

iv. Decision (the decision to approve or not to approve the handling of a case according to the re-examination opinions).
