**Hainan Province Pre-hospital Emergency Medical Service Management Regulations**  


(Adopted at the 20th Meeting of the Standing Committee of the Seventh Hainan Provincial People's Congress on September 30, 2025)  


**Article 1**  

These Regulations are formulated in accordance with the *Basic Healthcare and Health Promotion Law of the People's Republic of China* and other laws and administrative regulations, taking into account the actual circumstances of Hainan Province, with the aim of safeguarding public life and health rights, standardizing pre-hospital emergency medical service practices, improving the capacity and quality of pre-hospital emergency medical services, promoting the high-quality development of pre-hospital emergency medical services, and supporting the construction of the Hainan Free Trade Port.  


**Article 2**  

These Regulations apply to pre-hospital emergency medical services and their supervision and management within the administrative region of Hainan Province.  


For the purposes of these Regulations, "pre-hospital emergency medical services" refer to medical activities carried out by pre-hospital emergency medical service institutions under the unified dispatch of command and dispatch institutions, prior to delivering patients to in-hospital emergency medical service institutions. These activities primarily include on-site rescue, emergency treatment during transport, medical monitoring, and handover activities with in-hospital emergency medical service institutions.  


For the purposes of these Regulations, "pre-hospital emergency medical service institutions" refer to medical institutions legally approved to engage in pre-hospital emergency medical services, including emergency centers, emergency stations (points), and medical institutions incorporated into the pre-hospital emergency medical service network.  


For the purposes of these Regulations, "command and dispatch institutions" refer to institutions established by the health authorities of people's governments at or above the county level, responsible for receiving pre-hospital emergency calls within their administrative regions, directing pre-hospital emergency medical service institutions, and providing professional guidance.  


For the purposes of these Regulations, "in-hospital emergency medical service institutions" refer to medical institutions with emergency rescue capabilities that receive and treat patients transported by pre-hospital emergency medical service institutions.  


**Article 3**  

Pre-hospital emergency medical services are government-organized, non-profit public welfare undertakings and shall adhere to the principles of government leadership, resource sharing, safety, and efficiency.  


Pre-hospital emergency medical services and non-emergency medical transport shall adhere to classified services and management. No entity or individual may use the name of an emergency center (station, point) to provide pre-hospital emergency medical services without approval from the health authorities. Non-emergency medical transport services provided by public medical institutions shall not occupy pre-hospital emergency medical service resources.  


**Article 4**  

People's governments at or above the county level shall strengthen leadership in pre-hospital emergency medical services, incorporate the development of pre-hospital emergency medical services into national economic and social development plans, establish and improve financial funding mechanisms, and ensure that pre-hospital emergency medical services in their administrative regions align with economic and social development and residents' needs.  


Health authorities of people's governments at or above the county level shall be responsible for the overall coordination, supervision, and management of pre-hospital emergency medical services within their administrative regions.  


Development and reform, public security, finance, human resources and social security, transport, emergency management, medical insurance, communications management departments, and other relevant departments of people's governments at or above the county level, as well as fire and rescue agencies and the Red Cross Society, shall perform their respective duties related to pre-hospital emergency medical services.


**Article 5**  

Hainan Province shall establish an integrated land-sea-air pre-hospital emergency medical service system. People's governments at or above the county level shall improve the allocation of medical emergency resources, pre-hospital emergency medical service standards and procedures, strengthen quality control of pre-hospital emergency medical services, and establish a three-dimensional pre-hospital emergency medical network combining land, air, and water transport.  


People's governments at or above the county level shall, based on the medical institution establishment plan within their administrative regions and considering factors such as urban and rural layout, regional population size, service radius, traffic conditions, and the distribution and capacity of in-hospital emergency medical service institutions, formulate plans for the establishment of pre-hospital emergency medical service institutions within their administrative regions. They shall coordinate the layout of pre-hospital emergency medical service institutions, reasonably equip them with pre-hospital emergency ambulances in appropriate types and quantities, and plan and construct vehicle cleaning and disinfection sites equipped with cleaning and disinfection facilities.  


People's governments of coastal cities, counties, and autonomous counties shall, considering the characteristics of near-shore maritime and air emergency services, reasonably equip waterborne emergency transport vehicles, low-altitude aircraft, and corresponding emergency equipment through procurement, service agreements, leasing, or other means as needed.  


**Article 6**  

Hainan Province shall implement unified province-wide command, dispatch, operation, and coordination. A designated command and dispatch institution shall serve as the unified province-wide pre-hospital emergency medical service command and dispatch center, undertaking daily command and dispatch work for province-wide pre-hospital emergency medical services. Relying on the command and dispatch information platform, it shall conduct unified city-wide command and dispatch of pre-hospital emergency medical service institutions across the province. Based on the principles of unified reception and sorting, and territorial responsibility, it shall achieve unified reception of emergency calls, unified dispatch of pre-hospital emergency ambulances and personnel, and break down the pre-hospital emergency medical service pattern divided by administrative regions.


Command and dispatch institutions shall perform the following duties:  

1. Responsible for the professional guidance of pre-hospital emergency medical work within their administrative regions, specifically carrying out quality control of pre-hospital emergency medical services, and providing quality control reports to the health authorities;  

2. Participating in commanding medical support for major events and emergency medical rescue for public emergencies;  

3. Responsible for the command and dispatch supervision of pre-hospital emergency medical work within their administrative regions;  

4. Other duties stipulated by laws and regulations.  


**Article 7**  

Pre-hospital emergency medical service institutions shall perform the following duties:  

1. Comply with command and dispatch and undertake assigned pre-hospital emergency medical tasks;  

2. Register, maintain, and report pre-hospital emergency medical data and information in accordance with relevant regulations;  

3. Regularly conduct training and drills on emergency knowledge and skills for emergency personnel;  

4. Publicize and普及 first aid knowledge, and promote new first aid technologies;  

5. Other duties stipulated by laws and regulations.  


**Article 8**  

People's governments of cities, counties, and autonomous counties shall, in accordance with the unified plan of the provincial people's government, promote the信息化construction of pre-hospital emergency medical services, and build and improve pre-hospital emergency medical information systems that meet standards.  


The呼叫number for pre-hospital emergency medical services in Hainan Province is "120". The "120" pre-hospital emergency medical information system shall be interconnected and share information with platforms such as "110", "119", and "122", and shall possess functions for voice, graphic, video, and multi-language call modes.  


No entity or individual may maliciously dial or occupy the "120" emergency call number and line, nor may they impersonate pre-hospital emergency medical service institutions or use the name and标识of "120" to engage in medical emergency-related activities.  


**Article 9**  

Command and dispatch institutions shall set up a corresponding number of dedicated telephone lines based on population size and call volume to ensure unimpeded emergency call access, and shall configure dedicated call handlers to answer emergency calls 24 hours a day.  


Command and dispatch institutions may provide real-time translation services for call handlers and callers by establishing a foreign language expert database, using intelligent translation, purchasing人工translation services, or other remote assisted translation methods.  


Call handlers shall undergo training and qualify before assuming their posts; during duty, they shall promptly answer emergency calls, inquire and record patient information, register and process the information, and issue dispatch instructions in a timely manner.  


Patients and their family members or relevant persons on the scene shall cooperate with the call handlers' inquiries and truthfully provide basic information such as the patient's condition, location, and contact details.  


**Article 10**  

Personnel engaged in pre-hospital emergency medical services (hereinafter collectively referred to as emergency personnel) include physicians, nurses, and paramedics working in pre-hospital emergency medical services, as well as drivers and stretcher bearers.  


Each pre-hospital emergency ambulance performing pre-hospital emergency medical tasks shall be equipped with at least one physician, one nurse, and one driver.  


Emergency personnel shall wear unified attire according to their job requirements.  


Relevant persons on the scene shall cooperate when emergency personnel carry out pre-hospital emergency medical work.  


**Article 11**  

Physicians engaged in pre-hospital emergency medical services shall lawfully obtain practicing qualifications and meet one of the following conditions:  

1. Clinical category with a specialty in emergency medicine;  

2. Physicians in the traditional Chinese medicine category or clinical categories other than emergency medicine shall receive medical emergency knowledge and skills training organized by pre-hospital emergency medical service institutions and pass the assessment.  


Assistant practicing physicians shall provide pre-hospital emergency medical services under the on-site or remote guidance of practicing physicians.  


Nurses and paramedics engaged in pre-hospital emergency medical services shall lawfully obtain national vocational qualification certificates, receive emergency skills training organized by pre-hospital emergency medical service institutions, and pass the assessment.  


Drivers and stretcher bearers shall receive emergency skills training organized by pre-hospital emergency medical service institutions and pass the assessment.  


**Article 12**  

Pre-hospital emergency ambulances shall comply with national health industry standards and automotive industry standards, be uniformly painted or affixed with pre-hospital emergency identifiers and the call number, be equipped with warning lights and sirens, and configured with onboard medical equipment. Other ambulances shall not use identifiers, wording, or colors such as "120" or "Emergency Center (Station, Point)" on their appearance that may be confused with pre-hospital emergency ambulances.  


No entity or individual may configure or use pre-hospital emergency ambulances to provide pre-hospital emergency medical services in violation of regulations, nor may they install or use warning lights or sirens without authorization.  


Ambulances engaged in non-emergency medical transport services shall not use warning lights and sirens during routine transport services, except in emergencies or when participating in incident response or emergency medical rescue.  


Except when performing pre-hospital emergency medical tasks, pre-hospital emergency medical service institutions and their staff shall not擅自deploy pre-hospital emergency ambulances. If deployment is necessary for medical support at large-scale events, it shall be carried out in accordance with relevant provincial regulations.  


Pre-hospital emergency ambulances shall be equipped with fare meters and have price lists posted in conspicuous locations, indicating the names of收费 items, standards, and the price complaint hotline.  


**Article 13**  

Emergency personnel of pre-hospital emergency medical service institutions shall promptly answer dispatch instruction calls, comply with command and dispatch, and dispatch vehicles within the specified time; promptly contact the emergency caller to inquire about the patient's condition and provide guidance on first aid; upon arrival at the emergency scene, provide treatment to the patient in accordance with medical emergency operation standards, and promptly transport the patient to an in-hospital emergency medical service institution.  


If emergency personnel are unable to contact the emergency caller, cannot confirm the patient's address, cannot access the patient's location, or need to provide急救at scenes involving explosions, hazardous chemical leaks, violent assaults, etc., they may request assistance from public security organs or fire and rescue agencies, etc.; public security organs and fire and rescue departments shall provide timely assistance.  


During transport or treatment, if a patient exhibits dangerous behavior such as self-harm, endangering others, or damaging property, emergency personnel shall take protective measures and promptly report to the public security organs, which shall依法take protective restraint measures against the patient and assist in transport.  


**Article 14**  

Pre-hospital emergency medical service institutions shall, based on the patient's condition and following the principles of proximity, urgency, meeting professional needs, and considering the patient's preference, promptly deliver the patient to an in-hospital emergency medical service institution for treatment.  


If the patient or their guardian or family members request transport to another medical institution, the emergency physician shall inform them of the potential risks, and transport shall proceed after the patient or their guardian or family members provide written confirmation or the consent is recorded via audio or video.  


For patients falling under any of the following circumstances, the emergency physician shall decide to send them to the appropriate in-hospital emergency medical service institution for treatment:  

1. Critical condition, life-threatening;  

2. Sudden infectious disease or suspected infectious disease;  

3. Other circumstances stipulated by laws and regulations.  


Pre-hospital emergency medical service institutions and emergency personnel shall not violate patient transport principles to seek benefits for their unit or individuals.  


**Article 15**  

Before critically ill patients are delivered to an in-hospital emergency medical service institution, emergency personnel shall notify the intended receiving in-hospital emergency medical service institution of the patient's relevant condition in advance, and the in-hospital emergency medical service institution shall prepare for reception.  


After the patient is delivered to the in-hospital emergency medical service institution, emergency personnel shall hand over information such as the patient's condition, initial diagnosis, treatment, and medication to the receiving physician and nurse, and complete and preserve the patient handover form as required.  


In-hospital emergency medical service institutions shall, following the principle of first-visit responsibility, promptly receive patients and shall not refuse, delay, or procrastinate in receiving them, nor shall they detain pre-hospital emergency ambulances or onboard equipment and facilities.  


In-hospital emergency medical service institutions shall provide treatment according to the emergency triage and classification standards to ensure timely treatment for critically ill patients.  


Health authorities of people's governments at or above the county level shall organize and coordinate pre-hospital emergency medical service institutions and in-hospital emergency medical service institutions to establish effective衔接mechanisms.  


**Article 16**  

Pre-hospital emergency medical service institutions shall charge fees for pre-hospital emergency medical services according to the prescribed standards. Emergency personnel shall not refuse or delay treatment due to fee issues.  


Patients or their guardians or family members shall pay the fees according to the pre-hospital emergency medical service charging standards. If patients or their guardians or family members refuse the pre-hospital emergency ambulance service dispatched by the pre-hospital emergency medical service institution for their own reasons, they shall pay the pre-hospital emergency ambulance usage fee already incurred.  


If patients or their guardians or family members refuse to pay the pre-hospital emergency medical service fees, and their identity is verified and they have the ability to pay, the pre-hospital emergency medical service institution shall promptly report to the relevant departments, which shall assist in handling the matter.  


For unpaid pre-hospital emergency fees incurred by critically ill patients whose identity cannot be ascertained or who genuinely lack the financial means to pay, pre-hospital emergency medical service institutions may apply for payment from a special assistance fund in accordance with national and provincial regulations; in-hospital emergency medical service institutions shall provide necessary cooperation and assistance for the application for special assistance covering the pre-hospital emergency fees portion.  


**Article 17**  

When performing emergency tasks, pre-hospital emergency ambulances shall enjoy the right of way priority in accordance with the law. Other vehicles not performing emergency tasks and pedestrians shall yield and shall not obstruct their passage. If conditions allow for yielding but yielding is not provided, the command and dispatch institution may submit video recordings and other evidence of vehicles obstructing the passage of ambulances performing pre-hospital emergency tasks to the public security organs for handling according to law.  


Vehicles and pedestrians that violate traffic rules due to yielding to ambulances performing pre-hospital emergency tasks or participating in rescuing patients shall be exempt from administrative penalties after verification by the traffic management department of the public security organ.  


Traffic management departments of public security organs and transport departments of people's governments at or above the county level shall, within their respective职责, provide real-time road traffic information available to them to pre-hospital emergency medical service institutions, promptly guide traffic, and take measures to ensure priority passage for pre-hospital emergency ambulances performing emergency tasks.  


If a pre-hospital emergency ambulance encounters vehicle breakdown, traffic congestion, etc., en route and is预计unable to reach the emergency scene or the in-hospital emergency medical service institution on time, it shall immediately report to the command and dispatch institution and explain the situation to the emergency caller. The command and dispatch institution shall take measures such as dispatching another pre-hospital emergency ambulance to the emergency scene or requesting assistance from the traffic management department of the public security organ to guide traffic.  


**Article 18**  

Pre-hospital emergency medical service institutions shall not擅自cease or suspend the provision of pre-hospital emergency medical services.  


If a pre-hospital emergency medical service institution ceases or suspends the provision of pre-hospital emergency medical services for a reason, it shall report to the health authority that originally issued the medical institution practice license. Upon receiving the report, the health authority shall take necessary measures to coordinate the replenishment of pre-hospital emergency medical resources to ensure that pre-hospital emergency medical services in the area are not affected.  


**Article 19**  

In the event of incidents, other public safety emergencies, or the need for support during major activities, all pre-hospital emergency medical service institutions, in-hospital emergency medical service institutions, non-emergency medical transport institutions, and other social medical rescue forces in the province shall accept the unified command and dispatch of the government and participate in pre-hospital emergency medical service-related work.  


**Article 20**  

The provincial people's government health authority shall formulate career development and incentive保障policies for pre-hospital emergency personnel, and jointly with human resources and social security departments and others, establish and improve a comprehensive保障system including remuneration, professional title promotion, vocational training, post competition, job rotation, and personal insurance.  


People's governments of cities, counties, and autonomous counties with the necessary conditions are encouraged to promote the establishment of a mechanism for the rotation of emergency physicians between emergency centers (stations, points) and medical institutions.  


**Article 21**  

Health authorities of people's governments at or above the county level, the Red Cross Society, and other relevant units shall actively conduct first aid training, retraining, and普及first aid knowledge.  


Entities and individuals are encouraged to participate in pre-hospital emergency medical services through public donations, volunteer services, and other means.  


Management units of public places such as cinemas, theaters, stadiums, airports, railway stations, schools, and scenic spots shall equip themselves with automated external defibrillators (AEDs) and other medical emergency equipment according to relevant regulations, and maintain and update the equipment. Persons with medical急救skills may use AEDs and other first aid equipment for on-site emergency rescue.  


Persons with medical急救 skills are encouraged to provide on-site emergency rescue to critically ill patients before the arrival of emergency personnel. After emergency personnel arrive at the rescue scene, voluntary rescuers who wish to continue assisting shall comply with the arrangements and调度of the pre-hospital emergency medical service institution and its emergency personnel.  


On-site emergency rescue acts are protected by law, and no legal liability shall be borne for damages caused to the patient, in accordance with the law.  


**Article 22**  

Legally established volunteer organizations may recruit and organize volunteers to carry out medical急救public welfare publicity,普及medical急救knowledge, participate in on-site emergency rescue, and other medical急救 volunteer service activities.  


Entities and individuals may participate in medical急救volunteer service activities through volunteer organizations. Volunteer organizations shall provide volunteers with the safety, health, medical, and other conditions and保障required for medical急救volunteer services, and conduct relevant knowledge and skills training.  


Command and dispatch institutions may coordinate medical急救volunteers near the patient's location to voluntarily participate in on-site emergency rescue.  


Health authorities of people's governments at or above the county level shall promote the data interconnection and linkage between the pre-hospital emergency command information system, the volunteer service information system, and the AED information management system to achieve the衔接 between public first aid and professional medical急救.


**Article 23**  

Medical research institutions, universities, and medical institutions are encouraged to conduct research on medical急救techniques and methods, smart healthcare, facilities and equipment, and急诊医学-related research. The use of advanced medical science and technology in pre-hospital emergency medical services is supported.  


The promotion and application of traditional Chinese medicine diagnosis and treatment techniques and methods in pre-hospital emergency medical services are supported.  


**Article 24**  

The provincial people's government health authority shall strengthen medical急救 exchanges and联动 cooperation with neighboring provinces and promote the establishment of cross-regional medical急救cooperation mechanisms.  


**Article 25**  

If a command and dispatch institution or its call handlers violate these Regulations by any of the following circumstances, the health authority of the people's government of the city, county, or autonomous county shall order rectification; if serious consequences occur, the directly responsible person in charge and other directly responsible personnel shall be given sanctions according to law:  

1. Failing to answer emergency calls promptly;  

2. Failing to inquire or record patient information, or recording patient information incorrectly;  

3. Failing to issue dispatch instructions promptly or issuing incorrect dispatch instructions.  


**Article 26**  

If a pre-hospital emergency medical service institution or an in-hospital emergency medical service institution violates these Regulations by any of the following circumstances, the health authority or other relevant department of the people's government of the city, county, or autonomous county shall order rectification and may concurrently impose a fine of not less than RMB 5,000 but not more than RMB 20,000; if serious consequences occur, the directly responsible person in charge and other directly responsible personnel shall be given sanctions according to law; if damage is caused to others, civil liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law:  

1. Failing to comply with the command and dispatch of the command and dispatch institution, or failing to dispatch the vehicle within the specified time after accepting the command and dispatch;  

2. Failing to contact the emergency caller and provide first aid guidance as required;  

3. Failing to transport the patient as required;  

4. Refusing, delaying, or procrastinating in receiving the patient;  

5. Detaining the ambulance or onboard equipment and facilities;  

6. Failing to report as required before ceasing or suspending pre-hospital emergency medical services;  

7. Deploying pre-hospital emergency ambulances without following the prescribed procedures;  

8. Failing to equip with emergency personnel as required, or the equipped emergency personnel not meeting the conditions.  


**Article 27**  

If an entity or individual violates these Regulations by擅自configuring or using pre-hospital emergency ambulances or impersonating pre-hospital emergency ambulances to provide pre-hospital emergency medical services, the health authority of the people's government of the city, county, or autonomous county shall ban such activities, confiscate the illegal gains, drugs, and equipment, and impose a fine of not less than RMB 20,000 but not more than RMB 50,000; if warning lights or sirens are illegally installed, the traffic management department of the public security organ shall forcibly remove and confiscate them and impose a fine of not less than RMB 500 but not more than RMB 2,000.  


If a pre-hospital emergency medical service institution violates these Regulations by擅自 using pre-hospital emergency ambulances for other purposes, the health authority of the people's government of the city, county, or autonomous county shall order it to make corrections within a specified period; if corrections are not made by the deadline, a fine of not less than RMB 5,000 but not more than RMB 20,000 shall be imposed; if serious consequences occur, a fine of not less than RMB 20,000 but not more than RMB 50,000 shall be imposed, and the directly responsible person in charge and other directly responsible personnel shall be given sanctions according to law.  


**Article 28**  

If an entity or individual commits any of the following acts, disrupting the order of pre-hospital emergency medical services, which constitutes a violation of public security management, the public security organ shall impose public security management penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law:  

1. Maliciously dialing or occupying the "120" call number and line resources, or impersonating pre-hospital emergency medical service institutions or using the name and标识of "120", thereby preventing the normal operation of pre-hospital emergency medical services;  

2. Obstructing the passage of ambulances performing emergency tasks;  

3. Hindering emergency personnel from performing rescue acts by means of insult, threat, assault, etc.;  

4. Intentionally damaging ambulances and other pre-hospital emergency medical equipment and facilities;  

5. Other acts seriously disrupting the order of pre-hospital emergency medical services.  


**Article 29**  

For acts violating these Regulations for which no penalty is set herein but for which penalties are stipulated in other laws and regulations, those provisions shall apply.  


**Article 30**  

These Regulations shall take effect on November 1, 2025.
