Chapter I General Provisions

Article 1 For the purpose of meeting Hainan’s needs to further deepen reform and opening up, as well as encouraging and attracting overseas personnel to find jobs or start businesses in the Hainan Free Trade Port, these Measures are formulated, in accordance with the Master Plan for the Construction of the Hainan Free Trade Port and relevant provisions on professional qualification examinations of the People’s Republic of China, as well as the actual conditions in Hainan.

Article 2 These Measures are applicable to overseas personnel who take relevant professional qualification examinations in the Hainan Free Trade Port.

Article 3 Directory management shall be implemented for professional qualification examinations available to overseas personnel in the Hainan Free Trade Port. This directory shall be issued by the provincial talent work department and the provincial human resources and social security department, in conjunction with relevant provincial sectoral regulators, and shall be dynamically adjusted based on the development needs of the Hainan Free Trade Port. Where there are new national provisions, such new provisions shall prevail.

Article 4 Overseas personnel participating in professional qualification examinations in the Hainan Free Trade Port shall be subject to uniform examination standards, examination organization, and certificate issuance, consistent with those applicable to domestic candidates.

Chapter II Registration and Examinations

Article 5 Any overseas personnel who comply with the laws and regulations of the People’s Republic of China, adhere to professional ethics, and meet the requirements specified for professional qualification examinations at the national or Hainan provincial level (excluding nationality requirements) may voluntarily register to take corresponding vocational qualification examinations for their respective professions and levels. Work experience gained overseas by these personnel may be considered equivalent to domestic work experience.

The specific registration requirements for each professional qualification examination shall be published by provincial sectoral regulators responsible for managing that particular examination or professional qualification examination institutions.

Article 6 Overseas personnel registering for professional qualification examinations shall complete the Professional Qualification Examination Application (Approval) Form and submit a copy of their valid identification documents to sectoral regulators or professional qualification examination institutions along with documentation proving their years of work experience in the relevant profession and other related materials, in accordance with the relevant registration regulations. For Hong Kong, Macau and Taiwan compatriots, a valid Mainland Travel Permit for Hong Kong and Macau Residents, a Mainland Travel Permit for Taiwan Residents, or a Residence Permit for Hong Kong, Macao and Taiwan Residents shall be submitted. For foreigners, a valid passport, visa, or Foreign Permanent Resident ID Card shall be submitted.

Article 7 Sectoral regulators or professional qualification examination institutions shall conduct a qualification review of applicants based on management authorities. An admission ticket shall be issued for those who pass the qualification review. Candidates shall take examinations in accordance with the time and venue indicated on the admission ticket.

Article 8 When sectoral regulators or professional qualification examination institutions release an announcement or notice on a professional qualification examination, they shall clearly indicate the relevant provisions on the participation of overseas personnel in the examination, and the examination registration shall be completed within a time limit; when overseas personnel take the examination, they shall bring their valid identity documents and admission tickets used for registration, use the prescribed examination stationery and give answers as required.

Article 9 Overseas personnel taking the professional qualification examination shall follow the examination disciplines and the relevant provisions. Personnel who violate the examination disciplines and the relevant provisions shall be punished pursuant to the national or Hainan provincial provisions for violations of rules and regulations in the professional qualification examinations.

Chapter III Certificates and Benefits

Article 10 For foreigners who have passed the exam, sectoral regulators or professional qualification examination institutions shall process the formalities for the issuance of professional qualification certificates in the Hainan Free Trade Port as stipulated, and report the list of personnel who have obtained the said certificates to the Talent Development Bureau of the CPC Hainan Provincial Committee for filing.

Article 11 The professional qualification certificate of the Hainan Free Trade Port obtained by overseas personnel through passing the examination is proof that the personnel possess the knowledge and capability necessary for engaging in the corresponding profession, and is valid in the Hainan Free Trade Port (where the State has opened professional qualification examinations to overseas personnel, a national unified certificate shall be issued, which is valid nationwide).

Chapter IV Supplementary Provisions

Article 12 Relevant national or Hainan provincial provisions shall apply to the charging standards for professional qualification examinations for overseas personnel.

Article 13 These Measures shall be jointly interpreted by the Talent Development Bureau of the CPC Hainan Provincial Committee, the Department of Human Resources and Social Security of Hainan Province, and the provincial sectoral regulators.

Article 14 These Measures shall come into force as of the date of issuance.
